In 1978, the Constitution (44th) Amendment Act was passed by the then ruling Janata Party, repealing the right to property accorded to every citizen in Article 19(1)(f) and Article 31.The Forty-fourth Amendment of the Constitution of India, officially known as the Constitution (Forty-fourth Amendment) Act, 1978, was enacted by the Janata Party which had won the 1977 general elections campaigning on a promise to "restore the Constitution to the condition it was in before the Emergency". The Amendment aimed to undo several changes that had been made to the Constitution by the 42nd Amendment which had been enacted by the Indira Gandhi-led Indian National Congress during the Emergency.
Some of the changes introduced by the Act are as follows:
- Constitutional protection to publication in newspaper of the proceedings of the Parliament and State Legislatures.
- The President may only once send advice of the Cabinet for reconsideration.
- Restoration of some powers of the Supreme Court.
- Fundamental Rights Guaranteed by Articles 20 and 21 cannot be suspended during a national emergency.
- The Right to Property was deleted from the list of the fundamental right. It is now only a legal right under the Constitution.
